What can they expect?
At the initial consultation you will need to provide statements for all bank, investment, whole life insurance, and annuity accounts for the last 4 months, along with your most recent income statements from all sources- social security, disability, veterans benefits, pensions, and any other income. We will go through all of these with you. This is the
information we will have to submit with your application, so by reviewing these, we can explain how you may be able to qualify for Medicaid benefits.
Can Higher income/asset families qualify?
If you’re not currently earning a little over $100,000 per year, your income is not high enough to outright disqualify you from receiving medicaid. Florida allows the use of Qualified Income Trusts to allow those with income over the current limit, but under the average monthly nursing care to qualify.
We have helped families with nearly $2,000,000 in assets qualify for Medicaid benefits. Even when you have that much, paying $100,000 per year for nursing care will diminish
your assets quickly. Even if you have more than $2,000,000 we can probably do something to help, this issue at that point becomes asking whether the cost is worth the benefit- which is a question we can definitely help answer- and sometimes the answer is that you’ve done well and we don’t want to put you through the trouble for only a small
benefit.
Can I protect my spouse’s income from the nursing home?
Florida Medicaid rules allow for diversion of some spousal income. Spousal Diversion will often let you save some, but not all of your spouse’s income from being paid to the
nursing home. In some cases the nursing home resident’s income is very high, and losing all of that to the nursing home would make it impossible for the community spouse to continue to maintain their household. These cases require a special kind of spousal support.
It is possible to have the court enter a spousal support order awarding all but the personal needs allowance to the community spouse. Under these circumstances the married couple pays nothing to the nursing home- saving them nearly $125,000 per year!
What about people who have only a few thousand more than the asset or income limit?
Even when you have just a little more than the asset or income limit we can help you qualify. Sometimes that involves explaining how to spend the remaining funds for the benefit of the applicant or family members such that you will still be able to qualify for medicaid. Some potential clients ask “why not just pay a couple of months then apply for
Medicaid?” The reason we do this is to make sure people get the care they need for the best quality of life. Even just a few thousand extra dollars can make the difference
